Sadly, people die each day and sometimes through no fault of their own. When a person is killed through the negligence of another, it can be an overwhelming experience for the person's family. In such a difficult time it's important to know that the surviving dependents or beneficiaries are entitled to monetary damages as a result of the negligent defendant's conduct.

A wrongful death case is different than other types of personal injury cases because the victim (decedent) cannot bring the claim, rather the family members or the person's estate brings the suit. The purpose of the wrongful death suit is to provide compensation and relief to family members who have suffered emotionally and financially as a result of the person's death. Some of the damages the family may seek to recover include, but are not limited to:

    Wrongful death cases can be complex and time-consuming. Importantly, you have two years from the time of the person's death to file a law suit. (Section 95.11, Florida Statutes). That is why it is important to immediately preserve evidence, investigate the accident, interview witnesses, and file suit before the deadline imposed by Florida Statutes.
